Owning a Vacation Rental on Marco Island: A Practical Guide

Marco Island has a short list of rental rules on paper and a longer list of things that trip owners up in practice. This guide covers both, from the 2023 registration reversal to sea turtle season and salty sliders.

The short answer

Marco Island currently has no city vacation rental registration program. The voter-approved 2022 ordinance was declared void by City Council in October 2023 after a state law change, and the island is exempt from Collier County's registration ordinance. Owners still need a Florida DBPR vacation rental license, state and county tourist tax accounts, and must follow condo rules and the city's sea turtle lighting rules.

  • The 2022 Marco Island registration ordinance was declared void in October 2023 and the island is outside the county program.
  • A DBPR license and tourist tax registration still apply to nightly and weekly rentals.
  • Sea turtle season runs May 1 through October 31, and guests need to know the lighting and beach furniture rules.
  • Marco sits in Collier's most surge-vulnerable area, so every rental needs a written storm plan.

What rules apply to a Marco Island vacation rental right now?

In August 2022, Marco Island voters approved a vacation rental registration program for single-family homes, and the city adopted it as Ordinance 2022-08. It never took full effect. On October 2, 2023, City Council adopted Resolution 23-54, declaring the ordinance void because of Senate Bill 250 (Chapter 2023-304, Laws of Florida), which barred local governments near Hurricane Ian's landfall from adopting more restrictive land development rules for a period after the storm.

Marco Island is also outside the county program. Collier County's short-term vacation rental registration page lists the City of Marco Island as exempt from Ordinance 2021-45.

That leaves the layers that apply everywhere in Florida: the DBPR vacation rental license, the state and county tourist taxes, and your condo or HOA documents. Rules can change, so confirm with the City of Marco Island before you list. This is general information, not legal advice.

Condo association rules often matter most

Many Marco Island rentals are condos along Collier Boulevard and the beachfront, and association documents are frequently stricter than any government rule. Before you buy, and again before you list, read the declaration, rules and any rental policy amendments.

  • Minimum stays and rental caps. Some buildings set minimum lease lengths or limit rentals per year.
  • Guest registration. Front desks may need names, plate numbers or a copy of the booking in advance.
  • Parking and passes. Spaces, beach access passes and pool wristbands are often limited per unit.
  • Service vendors. Cleaners may need to check in, use a service elevator or stay out of certain areas at certain hours.

Put every association rule a guest must follow in your house manual and arrival message. Front-desk friction is one of the fastest ways to earn a bad first impression.

When is sea turtle season, and what do guests need to do?

The city's beach guidance gives the statewide nesting and hatching season as May 1 through October 31, and asks residents to turn off or shade unnecessary lights by 9 PM. The Marco Island Police Department's sea turtle page adds the practical rules:

  • If you can see your shadow on the beach at night, the light is too bright.
  • Close blinds and curtains on beach-facing windows, and shield outdoor lights.
  • No flashlights or flash photography on the beach at night.
  • Remove all beach furniture, equipment and trash from the beach every night.
  • Fill in holes dug in the sand before leaving.

The city cites its Sea Turtle Protection Ordinance (01-35). Guests rarely know any of this, so add a short sea turtle card to the unit and the arrival message, and add "beach-facing blinds closed" to your turnover reset from May through October.

Trash, recycling and checkout instructions

Island collection days and building trash rooms vary, and guests who leave on a Saturday do not know your schedule. Put the collection days for your street or building in the house manual, label the bins, and say where bagged trash goes at checkout.

Keep the guest's checkout list short and specific: trash in the right place, dishes in the dishwasher, lanai doors locked, beach gear rinsed and stored. Our guide to Airbnb checkout instructions has a sample list that works for island rentals.

Your hurricane plan as a Marco Island host

Collier County describes Evacuation Zone A as its most vulnerable area, covering areas west and south of US 41, where storm surge and large waves are the main dangers. Marco Island falls in that coastal area, so expect evacuation orders to reach the island early when a storm threatens.

The city's hurricane preparedness page says the Emergency Operations Center activates when a hurricane warning is issued, and asks residents to sign up for CodeRED alerts and the city's email news alerts. The city also broadcasts storm information on AM 1690.

Write down how you will contact guests, who secures the lanai, and who inspects after the storm. Our hurricane plan for vacation rental hosts lays it out step by step.

Salt air and sand: maintenance that never stops

Gulf breezes leave a salt film on glass, screens and metal, and it builds faster on beachfront units. Sliders get gritty, door tracks fill with sand, and hinges and lanai hardware corrode if nobody rinses them.

  • Clean slider glass and tracks at every turnover, not just at deep cleans.
  • Rinse outdoor furniture and railings regularly and replace corroded fasteners early.
  • Set a rinse station or foot brush by the entry and a basket for beach toys.
  • Ask your AC contractor how often a unit this close to the water should be serviced.

For the how-to, see how to clean salt spray off windows and sliders.

Cleaning logistics on the island

Turnovers on Marco Island have their own rhythm. In season, traffic on and off the island adds time, condo service rules can limit when a crew can arrive, and parking for vendors is often tight. Building elevators and long hallways add minutes to every load of linens.

Make it easy on whoever cleans: give clear access instructions, keep spare linen sets and a stocked owner's closet in the unit, and share your booking calendar so cleans are scheduled automatically.

That is how our team works on Marco Island. We schedule turnovers from your Airbnb, VRBO, Hospitable, Guesty or OwnerRez calendar link, put fresh linens on every bed, restock guest supplies from your owner's closet, clear salt film from lanai sliders and sweep sand from the tracks, then send a checkout report with photos of any damage, stains or missing items. If that would help, our vacation rental cleaning page has the details.

Questions people also ask

Do I need a permit to Airbnb my house on Marco Island?

There is no active city registration program after Resolution 23-54 voided the 2022 ordinance, and the island is exempt from Collier County's registration. You still need a Florida DBPR vacation rental license and tourist tax accounts. Confirm current requirements with the city before listing.

Why was the Marco Island rental ordinance thrown out?

The city declared it void in October 2023 because Senate Bill 250, passed after Hurricane Ian, barred local governments near the landfall area from adopting more restrictive or burdensome land development rules for a period, and voided some recently enacted ones.

Can guests leave beach chairs on the beach overnight on Marco Island?

No. The Marco Island Police Department asks that all beach furniture, equipment and garbage be removed from the beach every night, which protects nesting sea turtles and hatchlings. Tell guests in your house manual where to store chairs and umbrellas.

Is Marco Island in a hurricane evacuation zone?

Yes. Collier County's Zone A, its most vulnerable storm surge area, covers areas west and south of US 41, which includes the island. Look up your exact address with the county's evacuation zone lookup tool and sign up for the city's CodeRED alerts before the season starts.

What taxes do Marco Island vacation rentals pay?

Marco Island rentals pay the same state transient rental tax and Collier County tourist development tax as the rest of the county on stays of six months or less. Airbnb and VRBO collect on their bookings; confirm current rates with the Collier County Tax Collector.
